Transport Provider Terms & Conditions (Driver)

1. Introduction

1.1 Who We Are

blackcab.com Limited company number 14189502 (“we”, “us”, “our”) is a technology platform that connects licensed drivers (“Driver”, “you”, “your” “transport provider”) with passengers seeking transportation services. blackcab.com is not a transportation provider, taxi operator, or employer of Drivers. We provide a platform to facilitate hirings and improve access to transportation services. We are not your agent, other than for collecting certain fees, as set out herein, that may be applicable from time to time.

1.2 The Service

Through the Blackcab.com platform, you can:

Accept hiring requests from passengers via the web browser or mobile application.
Receive payments directly from passengers or (where applicable) through us, with no commission charged by blackcab.com. Credit Card fees may apply.
Access different hiring options, such as Virtual Hand, Registered User, and VIP hirings.

All transportation services provided by Drivers are fully independent and must comply with applicable licensing regulations at all times.

1.3 Contractual Relationship

By registering with blackcab.com, you acknowledge, warrant and agree that:

You are 21 years old or over.
You are an independent contractor, not an employee, agent, or representative of blackcab.com.
Your relationship with blackcab.com is strictly that of a service provider using a technology platform.
You retain full control over your working hours, acceptance of jobs, and operational decisions, subject to licensing regulations and blackcab.com’s cancellation policies.
blackcab.com does not act as an agent for the provision of transportation services.
blackcab.com assumes no liability for the conduct, actions, or omissions of drivers or passengers to the maximum amount permissible by law.
You indemnify blackcab.com against all and any claims, damages, accidents or losses arising from your conduct, services, or failure to comply with licensing laws, to the full extent permitted by UK law.

By using the platform, you fully agree to these Terms & Conditions.

2. License to Use the Platform

blackcab.com grants you a non-exclusive, non-transferable, and non-sublicensable license to use the platform strictly for providing transportation services.
You must not or allow others to decompile, reverse engineer, modify, or create derivative works from the platform.
Unauthorised access or misuse may result in account suspension, termination or legal action against you.

3. Use of Branding

blackcab.com grants you a limited, revocable license to use its branding strictly for transportation services.
Upon termination of your account, you must cease using any blackcab.com branding materials immediately.

4. Intellectual Property Rights

All intellectual property related to the blackcab.com platform is owned by blackcab.com and protected under applicable laws.
You must not use, copy, or distribute any intellectual property without explicit authorisation, including any advertising paraphernalia.

5. Identity Verification

blackcab.com reserves the right to verify your identity at any time.
Failure to pass identity verification may result in account suspension or termination.

6. Types of Hirings

6.1 Virtual Hand (E-hail) Hiring

No contract is formed upon acceptance of a Virtual Hand hiring.
You may cancel without penalty, and passengers may cancel without penalty.
Payment is made directly to you via cash or card. blackcab.com does not collect any fees or store passenger payment details for these hirings and is not liable to you for payment, if the passenger does not have the ability to pay the fare.

6.2 Registered User Hiring

Requires a minimum rating of 4.3*.
After 3-minutes, an agreed contractual obligation is formed upon acceptance of the hiring. See Clause 8 for mutual Cancellation Fees.

6.3 VIP Hiring

Requires a minimum rating of 4.6*.
After 3-minutes an agreed contractual obligation is formed upon acceptance of the hiring. See Clause 8 for mutual Cancellation Fees.

7. Driver Eligibility and Responsibilities

You warrant and represent that:

You are 21 years or older.
You hold a valid driving licence and taxi licence issued by the relevant authority.
You have passed a DBS check within 3-years.
Your vehicle is roadworthy and fully compliant with licensing requirements.
You maintain valid hire and reward insurance at all times.
You notify us immediately of any changes affecting your ability to provide services.
You will immediately inform us of any changes to your personal details or ability to provide the services.
You ensure passenger safety, comfort, and security at all times.

8. Hiring Acceptance, Cancellations & Compensation

8.1 Compensations Exceptions

Drivers will not be liable for any compensation if they arrive at the destination and the passenger is ‘not fit to travel’.
The following list of ‘not fit for travel’ reasons is a guide and is not exhaustive:

More than the maximum number of persons the taxi is licensed to carry.
Any Passenger that is visibly drunk or in need of medical attention.
Passenger(s) refusal to dispose of food and/or beverage prior to entering the vehicle.
Passenger has an animal that is not an assistance dog.
Passenger(s) have an excessive amount of suitcases or other items not suitable to be carried in a taxi, such as large furniture that might soil or damage the taxi.

9. Fees and Payments

All fares are regulated by the licensing authority.
No commission is charged by blackcab.com on consumer hirings.
Some hirings may include an approved Booking Fee, which is our fee and must be remitted to blackcab.com upon demand if charged or collected by you.

10. Performance and Ratings

You must maintain a high rating to continue accessing bookings and VIP hirings.
blackcab.com reserves the right to adjust or remove ratings where necessary.

11. Liability, Indemnities & Insurance

blackcab.com is not responsible for accidents, injuries, conduct or any disputes between passengers and drivers.
Drivers are responsible for resolving accident and injury incidents through their own insurance provider.
blackcab.com does not mediate disputes but may deduct applicable fees.
Drivers are solely responsible for their own tax and VAT obligations.
blackcab.com does not guarantee that the passenger has the resources to pay the fare.

12. Disclaimers

blackcab.com does not warrant the performance or availability of the platform and accepts no liability for loss of earnings or opportunity due to failures or unavailability of the software application or mobile communication or other.
blackcab.com does not guarantee that the app or platform will function without errors or interruptions.

13. Data Protection

Passenger data must only be used to fulfil a hiring and must be deleted after completion.
You must comply at all times with all applicable data protection laws.

14. Communication and Notices

blackcab.com may send notices via email, SMS, or in-app messages.
You must ensure your contact details are kept up to date at all times.

15. Termination

blackcab.com reserves the right to suspend or terminate your access for breaches of these Terms & Conditions, applicable laws, low ratings, excessive cancellations, failure to pay Cancellation Fees or no-shows or general poor and unprofessional conduct.

16. Amendments

blackcab.com may update these Terms & Conditions at any time. Continued use constitutes acceptance of the updated terms & conditions.
